Employment is a contract between two parties, one being the employer and the other being the employee. An employee may be defined as: "A person in the service of another under any contract of hire, express or implied, oral or written, where the employer has the power or right to control and direct the employee in the material details of how the work is to be performed." Black's Law Dictionary page 471 (5th ed. 1979).

In a commercial setting, the employer conceives of a productive activity, generally with the intention of generating a profit, and the employee contributes labour to the enterprise, usually in return for payment of wages. Employment also exists in the public, non-profit and household sectors. To the extent that employment or the economic equivalent is not universal, unemployment exists.

Can I collect unemployment insurance if my employer is a nonprofit with less than 4 employees?
Q. My employer was not required to pay unemployment tax. I am now unemployed and my employer would not contest my getting unemployment. However, my employer was not required to pay unemployement tax. My employer is a nonprofit with less then 4 employees in Ohio.

A. Probably not since they didn't pay in for you. Corporate officers can elect to be covered or not as a whole group but then if the company doesn't pay not can collect no matter what happens to the company. I would say you aren't going to collect but you may as well apply maybe you had covered employment from other jobs you could collect on.

What happens when a potential employer calls my current employer?
Q. As of now I am still working, but I am looking for another job that will offer me more hours at work. However when an application asks if its okay to contact your previous/current employer, should I say yes? I have been working at this place for almost 2 years, but is there a slight possibility that I may get terminated if my current employer finds out I'm looking for a new job? Because something similar happened to someone else. So on the application should I mark yes or no? Also do potential employers really call previous/current employers?

A. SAY NO!!! NO!!! NO!!! Absolutely NOT!!! And tell them why--say "I'm still working at this job, and my employer might take a dim view of my seeking a new position." Write it on the application. Prospective employers understand. Provide references from your previous employers if you can (assuming they're good). The fact that you still have a job is somewhat of a reference, in and of itself. I've made and received those calls. I usually ask about things like work ethic, punctuality, work product, initiative, and sometimes ask the "general question"--the old "What can you tell me about X?
